Terms of Service

By purchasing access to Oceanfront AI you agree to these Terms of Service in full. If you do not agree with these terms, do not complete your purchase.

1. The Service

Oceanfront AI is a mentorship program delivered primarily through Discord. The program may include access to a private Discord community, a structured video curriculum focused on AI automation for traders, one to one mentoring calls, group calls, educational resources, and other related materials or services. Prior to purchase, prospective members are given the opportunity to ask questions regarding the nature, structure, and delivery of the program. By completing payment you confirm that you understand the service being purchased and have had sufficient opportunity to seek clarification regarding any aspect of the program.

2. Membership Tiers

Oceanfront AI is offered in different tiers, which may include the Oceanfront AI Member tier, the Mentorship Student tier, and a Done For You tier. Each tier includes different features and levels of access, as described at the point of purchase. References in these Terms to Members and Students refer to purchasers of the respective tiers.

3. One Time Purchases

All purchases of Oceanfront AI are one time purchases. There is no recurring billing, no subscription, and no automatic renewal. Access is granted for the period stated at the point of purchase.

4. Digital Delivery and Commencement of Service

Oceanfront AI is a digital educational and mentorship service. By purchasing access to the program you expressly acknowledge and agree that service delivery begins immediately upon the granting of Discord access, or access to any program materials, curriculum, community resources, or mentorship services. Access to the Discord server, course materials, community resources, or any portion of the program constitutes commencement of service delivery. Access alone constitutes delivery of the service, regardless of the extent to which the member chooses to participate in, engage with, or consume the available content, resources, mentorship calls, or community features.

5. Refund Policy

Except where required by applicable law, all sales are final and non-refundable. No refunds will be issued once Discord access, course access, community access, or access to any program materials have been granted. This applies regardless of the amount of content consumed, whether scheduled calls have taken place, dissatisfaction with the format, structure, or delivery of the program, a belief that the program is not suitable for your circumstances, misunderstanding of the program after purchase, failure to participate in the program, or a change of mind for any reason. By completing payment you acknowledge that you understand the nature of the service being purchased and agree to this refund policy.

6. Chargebacks and Payment Disputes

If a chargeback or payment dispute is initiated, Oceanfront AI reserves the right to immediately suspend or revoke access to the program, Discord community, course materials, mentorship calls, and any associated memberships, pending resolution of the dispute. Oceanfront AI may submit evidence to payment processors, banks, card issuers, or dispute resolution providers in support of its position. Such evidence may include, but is not limited to, sales call recordings, payment records, Discord access logs, course access records, community participation records, message history, email communications, onboarding records, written agreements, and other documentation demonstrating customer agreement to, and delivery of, the service.

7. Call Recording

Calls, including onboarding calls, mentorship calls, and sales calls, may be recorded. By participating in any call you consent to being recorded. Recordings may be used to support onboarding, to improve the service, and as evidence in the event of a payment dispute. Further detail is provided in our Privacy Policy.

8. Results Disclaimer

Oceanfront AI provides educational content, mentorship, and training only. We do not guarantee any specific financial results, trading outcomes, business outcomes, income, profitability, or performance improvements. Results vary based on numerous factors, including individual effort, implementation, experience, skill level, and market conditions. Any examples of results presented by Oceanfront AI, its mentors, members, testimonials, case studies, marketing materials, social media content, or community discussions are illustrative only, and should not be interpreted as typical, expected, or guaranteed outcomes. Nothing provided within Oceanfront AI constitutes financial advice, investment advice, legal advice, tax advice, or any other regulated professional advice. Members remain solely responsible for all decisions made based on information obtained through the program.

9. Nature of the Service and No Financial Advice

Oceanfront AI is an AI education company. Our sole purpose is to teach the use of AI and automation. We do not provide financial advice, investment advice, or any other regulated professional advice, and we do not sell, provide, or recommend trading signals. Trading is discussed only because our primary clientele are traders, and the AI skills we teach are intended to supplement a trader's own workflow and journey. Nothing in the program is a recommendation to buy, sell, or hold any financial instrument. We make no promise, representation, or guarantee of any financial, trading, income, or performance result of any kind. The only guarantee we offer is the Student Outcome Guarantee set out in these Terms, which relates solely to the building of an AI notification system and nothing else.

10. Student Outcome Guarantee

This guarantee applies only to Mentorship Students. It does not apply to Members. If a Mentorship Student engages with the full program in good faith during their three month term, meaning they attend all of their included one to one calls on time and in full, and watch all of the curriculum videos, and they still do not have a working AI notification system by the end of the term, Luke will continue to work with them one to one at no additional cost for a reasonable period until a working system is built. Whether these conditions have been met, and whether a working system has been achieved, is determined by Oceanfront AI at its sole discretion. This guarantee is limited to continued one to one support only. It is not a guarantee of any financial, trading, income, or performance result. It does not entitle the student to any refund, credit, or monetary compensation. Continued one to one support is the student's sole and exclusive remedy under this guarantee.

11. Intellectual Property

All content provided through Oceanfront AI, including but not limited to videos, documents, templates, resources, recordings, written materials, curriculum content, community materials, and proprietary systems, remains the exclusive intellectual property of Oceanfront AI. You may not copy, reproduce, distribute, share, republish, sell, upload, transmit, or otherwise exploit any program content without prior written permission. Access to Oceanfront AI is personal to the purchaser and may not be shared, transferred, resold, sublicensed, or provided to any third party without prior written consent. Violation of this section may result in immediate termination of access, and may result in legal action where appropriate.

12. Limitation of Liability

To the fullest extent permitted by law, Oceanfront AI, its owners, mentors, and representatives shall not be liable for any indirect, incidental, consequential, or special damages arising out of or relating to the program. In all cases, the total liability of Oceanfront AI to any purchaser shall not exceed the amount that purchaser paid for the program. The program is provided on an as is basis, without warranties of any kind, whether express or implied, except as expressly stated in these Terms.

13. Termination

Oceanfront AI reserves the right to suspend or terminate any member's access to the program at any time for violation of these Terms of Service, abuse of staff or community members, disruptive conduct, sharing of confidential or proprietary materials, or any conduct deemed harmful to the program or community. No refund will be issued where access is terminated as a result of a breach of these Terms of Service.

14. Acceptance of Terms

By completing payment you acknowledge that you have read and understood these Terms of Service, you have reviewed and accepted the Refund Policy, you understand the nature of the program being purchased, you understand that service delivery begins once access is granted, you agree that access to the program constitutes commencement of service delivery, and you agree to be bound by these Terms of Service.

15. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. These Terms constitute the entire agreement between you and Oceanfront AI regarding the program, and supersede any prior communications or representations.

16. Changes to These Terms

Oceanfront AI may update these Terms from time to time. The version in effect at the time of your purchase applies to that purchase.

17. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms of Service shall be subject to the exclusive jurisdiction of the courts located within the State of Delaware.
